Birch Ridge House Rules – Student Accommodation in Melbourne

GENERAL

1.1. These House Rules have been established for the benefit of all tenants. All tenants are expected to abide by the House Rules. Management reserves the right to terminate the stay of any tenant found to be in breach of these House Rules.
1.2. All references to ‘the Act’ are to the Residential Tenancies Act 1997 (VIC). These House Rules apply in addition to your rights and responsibilities under the Residential Tenancies Act 1997 (VIC). Where these rules conflict with the Act, the Act prevails
1.3. Tenants must not sub-let their room or assign their tenancy without the prior express written approval of management. The landlord is entitled to require the tenant to bear any fees, costs or charges incurred by the landlord in connection with the preparation of a written assignment of a tenancy agreement. Please contact your premises manager with any queries.

security

2.1. Security is important for the safety of all tenants. Tenants must ensure that all windows and doors are locked upon leaving the premises.
2.2. When entering the premises, tenants must not let anyone tail them in or hold the door open for others.
2.3. Premises gates must be kept closed at all times.
2.4. All tenants are asked to call the emergency contact number if you encounter any stranger in the premises not accompanied by a tenant.
2.5. All tenants must lock car doors and avoid leaving valuables in their vehicles.

quiet enjoyment

3.1. Tenants must not do anything in or near the premises, or allow any visitors at the rooming house, to do anything which interferes with the privacy and peace and quiet of other tenants.
3.2. Any radios, televisions, computers, speakers or other devices must be adjusted so as to not disturb any other tenant. This includes any Skype or other personal calls made from the premises.
3.3. Tenants must regulate the volume of any conversations held in the common areas or their rooms, especially at night.
3.4. Tenants must take precautions to avoid slamming doors.
3.5. Tenants must take extra precautions to avoid noise after 10pm.
3.6. To avoid disturbance to other tenants, no ball games or video games are permitted in the common areas.
3.7. To avoid disturbance to other tenants, parties and large gatherings of visitors are not permitted anywhere on the premises.
3.8. Tenants must not use any gaming facilities between the hours of 10pm and 7am.

visitors

4.1. Visitors are required to be accompanied by a tenant at all times. These House Rules apply equally to any guests brought onto the property. Any visitor not accompanied by a tenant, or found in breach of these House Rules, will be asked to leave the premises.
4.2. Tenants must not bring more than 3 guests on to the premises at once.
4.3. Visitors are not allowed on the premises between 11pm and 7am. Tenants who breach this rule will be charged $100 and will receive a written warning.

keys & swipe cards

5.1. Access cards & keys (where required) will be issued to tenants upon their arrival. Failure to return allocated access cards and keys at the end of a tenancy will incur a fee of $20 per item, payable by the tenant.
5.2. Any lost access cards or keys will be replaced by management at a cost of $20 to the tenant. Tenants must notify management immediately upon losing a key or access card.
5.3. Any damaged access cards or keys will be replaced by management at the cost of $20 to the tenant.
5.4. Access cards or keys that have become faulty or inoperable due to normal wear and tear will be replaced by management at no cost.
5.5. A call-fee of up to $60 will be charged to any tenant if they require management to unlock their door.

cleaning & damage

A daily cleaning service may be provided to all common areas, however the following rules still apply to all tenants.

6.1. Tenants are required to clean and vacuum their rooms and keep them tidy. A vacuum is available for use by all tenants, who are required to return it to its place once finished using it.
6.2. If it is the reasonable opinion of management that a room is in an unacceptable state, tenants may be charged fees for having their room professionally cleaned. Such a direction may also be imposed following periodic Council health and well-being inspections.
6.3. Tenants are responsible for any damage to furniture, fixtures, fittings or equipment in the premises and may be charged for any repairs or maintenance required. This House Rule does not apply to fair wear and tear.
6.4. Tenants using the kitchen are required to clean and put away any cooking utensils after use, as well as cleaning the area after each use, obeying any kitchen rules on display.
6.5. Tenants using the laundry are reminded that these facilities are for tenants only. Clothes are not to be left in machines or the laundry generally. Clothes left for 1 day or more may be removed by management.
6.6. A condition report is given to all tenants prior to check-in must be filled out, signed and returned to manager at the premises within 3 business days of check-in. A failure to do so results in the original report being accepted as the accurate state of the room at check-in.
6.7. A tenant who becomes aware of damage to the premises must as soon as practicable give notice to management specifying the nature of the damage.

drugs & alcohol

7.1. Tenants must not consume alcohol in any of the common areas or store alcohol in any of the shared refrigerators.
7.2. The use or storage of any illicit substances is banned anywhere in the premises.
7.3. Smoking is strictly prohibited in the premises and common areas, including any courtyard or garden area.
7.4. Violence will not be tolerated. Any tenant who commits a serious act of violence and/or puts any other tenant or person on the premises will be subject to eviction immediately.

entry & inspection

8.1. An inspection will be held within the first month of a tenant’s tenancy to ensure that the condition report is accurate and that the room is being properly looked after.
8.2. Routine inspections of each room will be held every 6 months to ensure that the premises are being kept in a reasonable condition. Tenants may be subject to a cleaning charge as per House Rule 6.2 above.
8.3. Management may enter your room in an emergency, without notice, in order to save life, preserve valuable property or if there is a perceived threat or danger.
8.4. Management may enter your room between the hours of 8am and 6pm on any day, in line with the Residential Providers entry rights and responsibilities, as outlined on the Consumer Affairs Victoria website – here.

safety & emergency procedures

9.1. Double adaptors are a fire risk and tenants are prohibited from using them anywhere in the premises. If the number of power points provided is insufficient, tenants must use a power board with a 10 amp circuit breaker.
9.2. Candles, incense and any open flames are prohibited anywhere in the premises.
9.3. Tenants are prohibited from cooking anywhere except the kitchen.
9.4. Tenants must familiarise themselves with the Emergency Evacuation Plans located throughout the premises.
9.5. Tenants are reminded that in an emergency they should remain calm and follow directions from management and emergency services. Calmly leave the building by the nearest accessible exit
9.6. Tenants must not:
(a) Tamper with any fire safety equipment;
(b) Hang any items on fire sprinkler heads; or
(c) Cover, remove or disconnect any smoke alarms.
9.7. Heavy fines apply for the breach of any of the above.

termination & make good

10.1. Tenants must give management an appropriate notice period, in the appropriate form of intention to vacate, generally at least 28 days, in line with the guidelines listed on the Consumer Affairs Victoria website – here.
10.2. You will be charged rent for the notice period if the premises is vacated before the notice period expires or the residential tenancy agreement has not yet ended.
10.3. If a tenant is evicted or their tenancy is terminated by management due to a breach of the Act or these House Rules, that tenant’s bond may be forfeited to compensate the landlord.
10.4. When vacating the premises, outgoing tenants are required to observe the following requirements:
(a) all rubbish must be removed;
(b) your room must be vacuumed thoroughly (including the mattress and behind any furniture);
(c) all surfaces including skirting boards, blinds and furniture must be dusted and wiped down thoroughly;
(d) all walls must be cleared of posters or stickers and any adhesive marks must be cleaned;
(e) ensuites must be cleaned so that mirrors are free from marks, walls are free from marks and mould, basins are free from soap scum and toilets are free from stains or marks;
(f) empty any food locker and drawers in the kitchen, fridge or freezer and clean any marks or stains,
to return their room to the a clean & tidy state.
10.5. If the above rules are complied with, any bond lodged with the Residential Tenancies Bond Authority will be released to you, generally within 10 days of vacating the property.
